Hartwall shall not be held accountable or liable, either directly or indirectly, for any damage or loss incurred by the use of third party websites nor for the use of the content, products or services available through those websites and neither shall it be held accountable for the reliability of the information appearing on those websites. Materials sent to Hartwall
Prior to sending materials, users should take reasonable measures to ensure that the materials they send to Hartwall (a) have no illegal content or infringe upon rights and that they are not offensive or otherwise unsuitable for publication and (b), that they contain no viruses or other infective or destructive elements. Moreover, users must ensure that they own all rights to or otherwise control the rights to materials being sent to Hartwall and that Hartwall may use, publish, format and distribute the said materials without separate remuneration to the user. Users agree to take no action against Hartwall in connection with the materials they send to Hartwall, and they agree to provide reasonable assistance to Hartwall in the defence it undertakes in the event of possible action raised by a third party against Hartwall that may arise as a result of the materials they had send to Hartwall as well as to compensate Hartwall for the damage caused by any such action.
Personal data
Hartwall acts in accordance with the Personal Data Act when processing and filing personal data.
The use of certain internet services provided by Hartwall is only possible by registering as a service user. In order to fulfil its customer relations and services (incl. competitions), Hartwall may ask registered or unregistered users for specific personal data, such as name, address and telephone number, and for their email address if users wish to be contacted by email. Hartwall may ask for other necessary information, such as bank account number, in order to provide specific services related to its customer relations.
The personal data sent by users is saved in a personal data file maintained by Hartwall. Hartwall processes the personal data sent users for use by the services and functions it provides on its website, which include competitions, answering enquiries and feedback from visitors to the site, reimbursing consumers for financial losses resulting from Hartwall’s products, developing its products and services, as well as for statistical and other purposes involved in customer relations. Hartwall processes the personal data sent by a user for marketing purposes in accordance with the stipulations in the Personal Data Act. Hartwall shall not disclose personal data to a third party.
In accordance with the Personal data Act, users are entitled to send a written and signed request to the person responsible for Hartwall’s personal data file in order to examine their personal data. Upon the request of a user, Hartwall shall correct, delete or supplement without undue delay any erroneous, unnecessary, deficient or out of date personal data that is used for processing.
Website usage statistics and cookies
Hartwall may collect data on the use of its website and the number of visitors as well as for other statistical purposes and it processes and analyses the said data. Hartwall may use cookies in order to ease and speed up the use of its services and to monitor the use of its website content. A cookie is a small text file that the server saves on a user’s hard drive. In this way, Hartwall collects data on how and when its internet services are used in order make those services increasingly user friendly. The data collected by cookies cannot be used to identify individual users. A user’s internet browser will most probably accept cookies by default, but a user is generally able to change the browser settings and thus reject and delete cookies from the drive. Certain Hartwall internet services may require cookies to be enabled before those services can function properly.
Data security
The internet environment and the services it provides are not fully secure. Users are responsible for appropriately handling the data security on their own data systems.
Hartwall arranges data security for its website and services in a generally approved manner, it complies with the obligation to provide due care and observe good data processing practices, and it employs appropriate technical solutions in order to prevent unauthorised access to its data systems. However, Hartwall cannot guarantee complete data security.
No guarantees
THE USER EXPRESSLY UNDERSTANDS AND APPROVES THE FACT THAT (a) THE USER TAKES FULL RESPONSIBILITY FOR USE OF THE WEBSITE, THE WEBSITE IS PROVIDED “AS IS”, AND HARTWALL CONTESTS ALL SPECIFIC OR ASSUMED GUARANTEES; (b) THAT HARTWALL MAKES NO GUARANTEE THAT (i) THE WEBSITE CORRESPONDS TO THE USER’S EXPECTATIONS, (ii) THAT ACCESS TO THE WEBSITE WILL BE UNINTERRUPTED OR RELIABLE, ERROR-FREE OR AVAILABLE AT THE CORRECT TIME, AND (iii) THAT THE ACCURACY AND QUALITY OF THE INFORMATION THAT THE USER RECEIVES THROUGH THE WEBSITE CORRESPONDS TO THE USER’S EXPECTATIONS; (c) THAT THE USER IS SOLELY RESPONSIBLE FOR ANY DAMAGE TO OR LOSS OF DATA FROM HIS OR HER OWN DATA SYSTEM INCURRED BY DOWNLOADING CONTENTS FROM THE WEBSITE; AND (d), THAT NO ADVICE OR INFORMATION, EITHER IN WRITING OR GIVEN ORALLY, THAT THE USER RECEIVES FROM HARTWALL OR THROUGH A SERVICE CONSTITUTES IN ANY WAY LEGALLY BINDING ADVICE OR GUARANTEE THAT IS NOT EXPRESSLY DETAILED IN THESE TERMS AND CONDITIONS.

Limitation of liability
THE USER EXPRESSLY UNDERSTANDS AND APPROVES THE FACT THAT HARTWALL SHALL NOT BE HELD ACCOUNTABLE FOR ANY DIRECT OR INDIRECT DAMAGE, INCLUDING DELAY, DAMAGE RESULTING FROM LEAVING PART OF THE USER POTENTIAL OF THE WEBSITE UNUSED, THE LOSS OF INCOME, GOODWILL, USER RIGHTS, OR DATA OR ANY OTHER ECONOMIC LOSS THAT RESULTS FROM (i) USE OF THE WEBSITE OR THE FACT THAT IT COULD NOT BE USED, (ii) THE COSTS INVOLVED IN PROCURING A REPLACEMENT PRODUCT OR SERVICE THAT IS BASED ON DATA, INFORMATION OR A SERVICE OBTAINED THROUGH THE WEBSITE OR FROM A MESSAGE THAT WAS RECEIVED THROUGH THE WEBSITE, (iii) ILLEGAL ACCESS TO DATA TRANSFERS OR THEIR UNAUTHORISED MODIFICATION OR (iv), OTHER CONDITIONS RELATING TO THE WEBSITE.
Applicable legislation and legal venue
Finnish law shall be applied to the terms, conditions and provisions stated here as well as to the relationship between the user and Hartwall. Any possible disputes shall be resolved in a Finnish court of law, either at Helsinki District Court or in a general court of law located in the user’s place of domicile.
